By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the Service.

The Service and its original content, features and functionality are and will remain the exclusive property of High Peak Hearing Limited and its licensors.

Our Service may contain links to third-party web sites or services that are not owned or controlled by High Peak Hearing Limited.

High Peak Hearing Limited has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party web sites or services. You further acknowledge and agree that High Peak Hearing Limited shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such web sites or services.

Termination

We may terminate or suspend access to our Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.

Disclaimer

Your use of the Service is at your sole risk. The Service is provided on an “AS IS” and “AS AVAILABLE” basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement or course of performance.

Governing Law

These Terms shall be governed and construed in accordance with the laws of United Kingdom without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have between us regarding the Service.

Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.

Hearing aid warranty

This covers repairs in the event your hearing aid stops functioning through normal use. 

It will not cover loss or accidental damage/misuse. 

Additional 1 year warranty can be purchased at any time before 4 year warranty is lapsed at a cost of £50 per hearing aid.

Prices start at £85 per hearing aid. This will include an extended 6 month warranty period.

Hearing aid insurance

Warranties do not cover accidental damage only natural wear and tear. You will need to insure your hearing aids. Animals and children seem to be fascinated by hearing aids and they can easily get lost and/or crushed and even stolen if left in a bag.

Many people add them to their home contents insurance but this only insures the hearing aids whilst at your home. High Peak Hearing recommends Assetsure as they can offer all these extra benefits:

Hearing Aid Trials & Sales – Terms and Conditions

About These Terms

These Terms & Conditions apply to all hearing assessments, hearing aid trials, and hearing aid sales provided by High Peak Hearing Ltd.
By booking an appointment, trial, or purchasing hearing aids, you agree to the terms below.

Hearing Assessments

  • A hearing assessment fee is payable at the time of appointment unless stated otherwise.

  • Assessment fees are non-refundable once the appointment has taken place.

Hearing Aid Trials

  • Hearing aids may be provided on a trial basis at the discretion of High Peak Hearing Ltd.

  • All trial hearing aids remain the property of High Peak Hearing Ltd at all times.

  • Trial hearing aids must be returned by the agreed return date and in reasonable condition.

  • Clients are responsible for trial hearing aids while in their possession, including loss or damage.

  • Charges may apply for loss, damage, or failure to return trial hearing aids.

Ordering Hearing Aids

  • When a client confirms they wish to proceed with hearing aids, an order will be placed on their behalf.

  • Hearing aids are custom-programmed medical devices and cannot be resold as new once fitted.

  • By confirming an order, the client agrees to purchase the hearing aids under these Terms & Conditions.

Payment & Instalment Plans

  • Payment terms will be clearly stated on the client invoice.

  • Unless otherwise agreed in writing, payment is due in full on or before the fitting appointment.

  • Where an instalment plan is agreed, a deposit or first instalment must be paid before or at the fitting appointment.

  • Failure to make agreed payments constitutes a breach of contract.

Ownership of Hearing Aids

  • Hearing aids remain the property of High Peak Hearing Ltd until the invoice is paid in full.

  • Ownership transfers to the client only once full payment has cleared.

  • If payment is not made as agreed, High Peak Hearing Ltd reserves the right to:

    • Suspend aftercare, adjustments, servicing, and warranty support

    • Recover the hearing aids where legally permissible

    • Take formal debt recovery or legal action

Late or Non-Payment

  • Overdue accounts may be issued with reminder notices and formal payment demands.

  • Statutory interest and recovery costs may be applied in line with applicable law.

  • Unpaid invoices may be referred to debt recovery services or pursued through the courts without further notice.

Warranty & Aftercare

  • Manufacturer warranties and High Peak Hearing Ltd aftercare services apply only while accounts are up to date.

  • Aftercare, servicing, and repairs may be suspended if payments are overdue.

Cancellations & Returns

  • Cancellation and return terms will be explained before hearing aids are ordered.

  • Due to the bespoke nature of hearing aids, refunds may be limited once devices have been fitted and programmed.

  • Any applicable refund terms will be confirmed in writing.

Client Responsibilities

Clients agree to:

  • Provide accurate personal and contact information

  • Communicate promptly regarding payments or difficulties

  • Take reasonable care of hearing aids supplied

Legal Information

  • These Terms & Conditions are governed by the laws of England and Wales.

  • Any disputes are subject to the jurisdiction of the courts of England and Wales.

Acceptance of Terms

By booking an appointment, trial, or purchasing hearing aids, clients confirm they have read and accepted these Terms & Conditions.

Wax Removal Terms of Service

Wax removal via micro suction is considered safer than other methods such as syringing. However, syringing, irrigation, or probe removal may be undertaken if considered to be more appropriate by the audiologist.

Incidents during ear wax removal are uncommon, especially with micro-suction. However, possible minor risks that can occur and are deemed to be acceptable include: small nicks to the ear canal which can result in minor bleeding, soreness, mild discomfort and short-term ringing in the ear (tinnitus). To ensure the risk of complication is minimal, it is essential that accurate past medical history is supplied to our audiologist. More serious risk to the ear or eardrum can occur if the client cannot remain adequately still during the procedure. Clients should inform the audiologist of any likely movements.

Further possible complications, side-effects and material risks inherent in the procedure include but are not limited to the incomplete removal of ear wax requiring a return visit (for severely impacted wax), persistent tinnitus, perforation of the eardrum, hearing loss and infection. To keep the risk of infection to a minimum, all equipment used in the ear is sterilised or single-use. However, there is always a risk that infection may occur once out of the audiologist's care.

Please contact the audiologist for a follow-up visit should you experience any discomfort or worrying symptoms.

The CE marked suction unit is designed to remove fluids from the airway or respiratory support system and infectious materials from wounds. It has been adapted for the use of aural micro-suction.

By agreeing to these terms and conditions, you accept that you have read and understood the possible complications that may occur and agree that the audiologist cannot be held responsible for them.

The answers you provide will be stored along with other patient data and held as part of your case history. It will only be shared with other medical professionals where it helps with further assessment or treatment. It will never be used for marketing purposes. These records shall be kept for a minimum of 7 Years as recommended by BSHAA.
